PUBLIC OFFER
1. Terms and Definitions
1.1. Service Provider – AntiStressAcademy company, registration certificate No. 76367799, unified tax number 37255123, company address:
Flat A, 8/F, Kingswell Commercial Tower, 171 Lockhart Road, Wan Chai, Hong Kong.
1.2. Client – any legally capable individual who accepts this public offer under the terms of this agreement and participates in the educational program.
1.3. Service(s) – provision of educational activities based on an educational program funded by individuals and/or legal entities through education agreements; provision of psychological support to people in difficult life situations.
1.4. Website – the collection of texts, photo and video materials, graphic elements, designs, and other intellectual property, as well as software, owned by the Service Provider and made available via the Internet.
1.5. Supplementary Educational Program Passport – a set of core educational characteristics (volume, content, expected outcomes), organizational and pedagogical conditions, and in some cases, forms of assessment. It is presented as a curriculum, academic calendar, course syllabi, other components, as well as evaluation and methodological materials.
2. General Provisions
2.1. This public offer (hereinafter referred to as the Agreement) constitutes an official proposal from AntiStressAcademy to any capable individual to enter into an agreement for the provision of educational and/or psychological support services on the terms outlined herein.
2.2. By accepting this public offer, the Client acquires all rights and obligations defined in this Agreement.
2.3. Acceptance of the public offer shall be the Client's full or partial payment for the Service according to the selected rate (package, program).
2.4. Acceptance of this offer means the Client has reviewed the terms of the Agreement, the supplementary education program, the procedure for psychological support, the specifics of the payment system, and the functionality of the Website. The Client confirms the suitability of the payment system, services, and site for the intended purpose.
2.5. By accepting this offer, the Client confirms that the format of the Service fully meets their needs and capabilities.
2.6. By accepting this offer, the Client agrees to complete and sign a Consent Form for the Service Provider to process (collect, store, use, distribute, block, destroy) their personal data, including automated processing, for the purposes of executing this Agreement.
2.7. The Client accepts this public offer entirely, without exceptions or reservations.
2.8. To order a Service, the Client selects a suitable rate (package, program) on the Website and completes the order form by following the relevant link.
2.9. The Client confirms acceptance of the Agreement in full by checking the box "I accept the terms of the Public Offer" when placing the order. Lack of awareness of the Agreement terms does not constitute grounds for claims against the Service Provider.
2.10. This Agreement is deemed concluded once the Client’s payment is received in full by the Service Provider according to the chosen rate (package, program).
2.11. By accepting this offer, the Client consents to receiving informational and promotional messages from the Service Provider.
3. Subject of the Agreement
3.1. The subject of this Agreement is the provision of educational and/or psychological support services to the Client on a paid basis in accordance with the supplementary education program ordered.
4. Rights of the Parties
4.1. The Service Provider has the right to:
4.1.1. Provide psychological support using methods deemed appropriate by the assigned specialist.
4.1.2. Require timely payment from the Client as per the terms of this Agreement.
4.2. The Client has the right to:
4.2.1. Receive information about the Service provision process.
4.2.2. Contact the Service Provider for other services under a separate agreement.
4.2.3. Ask questions within the scope of the provided services.
5. Obligations of the Parties
5.1. Obligations of the Service Provider:
5.1.1. Provide accurate information about the offered services.
5.1.2. Provide services according to the selected program using appropriate facilities and learning materials.
5.2. Obligations of the Client:
5.2.1. Pay for the services on time, as defined by the selected rate/package.
5.2.2. Accept the services rendered.
5.2.3. Diligently participate in the educational program and/or follow psychological recommendations.
5.2.4. Follow all rules and policies set by the Service Provider.
5.2.5. Notify the Service Provider at least three (3) working days before the start of any session if they are unable to participate due to personal reasons.
6. Price and Payment Terms
6.1. The price and payment method for the Services are determined by the selected rate/package/program. Price increases after Agreement signing are not allowed unless linked to inflation as per the national budget forecast.
6.2. The total price includes all expenses incurred by the Service Provider.
7. Grounds for Modification and Termination
7.1. Terms may be amended by mutual written agreement of the Parties.
7.2. The Service Provider may unilaterally terminate this Agreement in cases including:
a) Disciplinary expulsion of students over age 15;
b) Failure to participate in the program;
c) Admission violations by the Client;
d) Late payment;
e) Client actions preventing service delivery.
7.3. Refund terms in case of unilateral termination by the Client are described in Appendix No. 1 “Refund Policy.”
8. Duration of the Agreement
8.1. This Agreement remains valid from the date of acceptance until both Parties fulfill their obligations.
9. Copyright Protection
9.1. The Website and Services contain intellectual property owned by the Service Provider or its authorized representatives.
9.2. By using the Website and Services, the Client agrees that all content, design, programs, and materials are protected under copyright law and other applicable laws. No content transfers to the Client.
9.3. The Client is not allowed to record, publish, copy, transmit, resell, or otherwise distribute materials provided under this Agreement. The Client may use the materials only for personal, non-commercial purposes.
9.4. Quoting from the Website is allowed only with written permission and a proper source citation.
10. Dispute Resolution
10.1. All disputes or disagreements that arise shall be resolved through negotiations between the Parties.
